Terms of Service

This English translation is provided for convenience only. The official text of these Terms is the Japanese version. In the event of any discrepancy, the Japanese version shall prevail.

These Terms of Service (the "Terms") set forth the conditions for using the digital stamp rally creation service "Stamp Rally Maker" (the "Service") provided by VirtualCross ("we", "us"). By using the Service, you are deemed to have agreed to these Terms.

Article 1 (Definitions)

  1. "Organizer" means a user who registers an account to create and operate stamp rallies.
  2. "Participant" means a user who takes part in a stamp rally published by an Organizer.
  3. "Content" means text, images, audio, video, and any other information an Organizer registers on the Service.

Article 2 (Accounts)

  1. Organizers shall register their account with accurate information and manage their credentials at their own responsibility.
  2. We are not liable for damages arising from unauthorized use of an account, except in cases of our willful misconduct or gross negligence.

Article 3 (Plans and Payment)

  1. The Service offers free and paid plans. The features and fees of each plan are shown on the plan management page.
  2. Fees for paid plans are charged by credit card (Stripe) at the time of subscription and automatically every month thereafter. Fees are billed in Japanese yen.
  3. You may cancel at any time. After cancellation, the plan remains available until the end of the current billing period; no prorated refunds are provided.
  4. If payment cannot be confirmed, we may suspend paid features and apply limits equivalent to the free plan.

Article 4 (Rights and Responsibility for Content)

  1. Copyright and other rights in Content belong to the Organizer or the rightful owner.
  2. The Organizer grants us a license to use Content to the extent necessary to provide and operate the Service (delivery to Participants, thumbnail generation, etc.).
  3. The Organizer warrants that its Content does not infringe the rights of any third party. Images generated with the AI image generation feature are likewise used at the Organizer's own responsibility.
  4. Data containing Participants' personal information, such as entry forms set up by an Organizer, shall be handled lawfully at the Organizer's own responsibility.

Article 5 (Prohibited Conduct)

Users must not engage in any of the following:

  • Acts that violate laws, regulations, or public order and morals
  • Acts that infringe the rights of third parties (copyright, trademark, portrait rights, privacy, etc.)
  • Unauthorized access, reverse engineering, or interference with the operation of the Service
  • Falsifying stamp acquisition (spoofing location data, tampering with tokens, etc.) or any other fraudulent conduct
  • Providing benefits to antisocial forces or any equivalent conduct

Article 6 (Changes to and Suspension of the Service)

  1. We may change the content of the Service without prior notice, and may temporarily suspend it for maintenance, failures, or other unavoidable reasons.
  2. We may terminate all or part of the Service with at least one month's notice. In that case, any fees already paid for periods after the termination date will be refunded.

Article 7 (Restriction of Use and Deregistration)

If a user violates these Terms, we may, without prior notice, make Content private, restrict use of the Service, or suspend or delete the user's account.

Article 8 (Disclaimer)

  1. We do not warrant that the Service is free of factual or legal defects.
  2. If a user suffers damage attributable to us, our liability is limited to the total fees received from that user during the most recent three months, except in cases of our willful misconduct or gross negligence.
  3. Disputes between Organizers and Participants, or between users, shall be resolved between the parties concerned; we will not be involved.

Article 9 (Amendment of the Terms)

We may amend these Terms when we deem it necessary. Material changes will be announced on the Service or by other appropriate means. Continued use of the Service after a change constitutes acceptance of the amended Terms.

Article 10 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. Any dispute arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Article 11 (Language)

These Terms are executed in Japanese. This English translation is provided for reference only, and the Japanese version shall prevail in the event of any discrepancy.
